Terms and Conditions (T&C) for CASHMERE SPA 

1. Scope of Application 

These Terms and Conditions (T&C) apply to all business relationships between NAS TEXTILE HUB GmbH (hereinafter referred to as the “Service Provider”) and the customer (hereinafter referred to as the “Customer”) relating to the services of CASHMERE Spa. The service includes the care, repair, and extension of the lifespan of high-quality textile products, particularly those made of cashmere and other fine materials. 

2. Subject of the Contract 

2.1 The Service Provider offers services for the care, repair, and extension of the lifespan of textile products. 

2.2 The Customer commissions the Service Provider with the care and/or repair of their textile products according to the specifications outlined in the order. 

3. Contractual Parties 

3.1 The contractual party of the Customer is NAS TEXTILE HUB GmbH, a service company that owns CASHMERE Spa. All contractual rights and obligations exist between the Customer and NAS TEXTILE HUB GmbH. 

3.2 The contract is established when the Customer commissions the Service Provider to care for or repair their textile products, and the Service Provider confirms this order. 

3.3 The order can be placed in writing, by telephone, or online. A written order confirmation from the Service Provider is not mandatory for the contract to take effect. 

4. Services of the Service Provider 

4.1 The Service Provider commits to executing the commissioned services diligently and professionally. 

4.2 The Service Provider reserves the right to reject orders if the textile products are so damaged that repair or care is not possible or appears uneconomical. 

4.3 The Service Provider is entitled to provide partial services if they are reasonable for the Customer. 

5. Cooperation and Benefits for Customers 

5.1 CASHMERE Spa enters into partnerships with various partners to offer additional benefits to its customers. 

5.2 Customers who come to us through these partners or utilize the respective partnerships will receive exclusive discounts and additional services offered within the scope of the partnerships. 

5.3 The specific conditions and additional services offered as part of each partnership may vary depending on the partner and will be communicated to the Customer when utilizing the services. 

6. Customer Obligations 

6.1 The Customer is obliged to provide all information and materials necessary for the execution of the order. 

6.2 The Customer must ensure that the textile products handed over are free of any damage that could impair the Service Provider’s services, unless such damage is the subject of the order. 

7. Prices and Payment Terms 

7.1 The prices for the services are based on the current price list of the Service Provider or the prices stated in the offer. 

7.2 Payments are due without deduction no later than 14 days after the invoice date. 

7.3 The Service Provider reserves the right to charge default interest at the statutory rate in case of late payment. 

8. Liability 

8.1 The Service Provider is liable for damages caused by intentional or grossly negligent conduct of its employees. 

8.2 Liability for damages caused by improper use of the textile products by the Customer or third parties is excluded. 

8.3 The Service Provider is not liable for damages resulting from normal wear and tear or aging of the textile products. 

9. Warranty 

9.1 The Service Provider guarantees that the services will be performed according to the state of the art and generally accepted standards of craftsmanship. 

9.2 Obvious defects must be reported in writing by the Customer within 7 days of receiving the textile products. 

9.3 In the event of a justified complaint, the Customer is initially only entitled to a remedy. 

10. Return and Collection 

10.1 The shipment to Cashmere Spa is the responsibility of the Customer, who also bears the associated costs.   

The return of the textile products is carried out at the expense and risk of Cashmere Spa unless the Customer is responsible for the return. 

10.2 Collection and delivery dates are binding and must be adhered to by the Customer. 

11. Data Protection 

11.1 The Service Provider collects, stores, and processes the Customer’s personal data solely for fulfilling contractual obligations and in compliance with applicable data protection laws. 

11.2 Data will only be shared with third parties as necessary to fulfill the contract. 

12. Final Provisions 

12.1 Amendments and supplements to these T&C must be in writing. This also applies to the waiver of the written form requirement. 

12.2 Should any provision of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. 

12.3 The place of jurisdiction for all disputes arising from this contract is the Service Provider’s registered office, provided the Customer is a merchant, a legal entity under public law, or a special fund under public law. 

12.4 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
